Managing Intellectual Property Magazine Names Firm Partners To IP Stars 2020 List

Woodard, Emhardt partners Spiro Bereveskos, Daniel J. Lueders and Charles P. Schmal were named to Managing Intellectual Property’s Patent Star 2020 list. In addition, Daniel J. Lueders and Charles J. Meyer were named to the Trademark Star 2020 list. The firm is also “recommended” in Indiana for intellectual property.

Managing Intellectual Property magazine’s “IP Stars” rankings are based on extensive research carried out over a six-month period by a team of researchers who sought responses from firms and clients, and reviewed publicly-available data. More information is available here.


Federal Circuit affirms judgment that CleanTech’s patents are unenforceable due to inequitable conduct.

GS CleanTech Corp. v. Adkins Energy LLC, No. 16-2231 (Fed. Cir. 2020)

Woodard Emhardt attorney, Spiro Bereveskos, was on the trial team and cross examined the Cantor Colburn, LLP attorney who admitted “it sent a chill up his spine” to learn the inventors had sent the offer letter more than a year before the filing of the patent application. The original suit alleged that the defendants infringed plaintiff’s family of patents relating to ethanol production processes. The ensuing litigation culminated in the Court finding that the patents were invalid and not infringed by any defendant. Those findings were further bolstered at a trial in which the Court then found the patents unenforceable due to inequitable conduct by the attorneys. Daniel J. Lueders Named America’s Top 100 High Stakes Litigators® for Indiana

 The law firm is pleased to announce that partner, Daniel J. Lueders, has been named to America’s Top 100 High Stakes Litigators® for Indiana in 2019. Membership to this group of 100 attorneys is awarded to less than 0.5 percent of litigators in the United States.

Membership among America’s Top 100 High Stakes Litigators® is meant to identify and highlight the accomplishments of the nation’s most esteemed and skilled litigators in high stakes legal matters. Dan was selected as an honoree for the second year in a row based on his role as lead counsel in legal matters with at least $2,000,000 in alleged damages at stake or with the fate of a business worth at least $2,000,000 at stake (i.e. bet-the-company litigation valued in excess of $2,000,000). Further assessment for this distinction included a review of Dan’s professional experience, legal achievements, significant case results, peer reputation, and community impact. Dan has served as lead trial counsel for both plaintiffs and defendants in both bench trials as well as jury trials. Woodard Emhardt Obtains Order Finding Exceptional Case and Awarding Fees in Litigation of Patent for Processing Ethanol Byproducts

December 18, 2018

In a multi-district case involving 26 defendants, Judge Miller of the U.S. District Court for the Southern District of Indiana, granted the defendants’ motion for an order declaring the case exceptional and awarded attorneys’ fees. The original suit alleged that the defendants infringed plaintiff’s family of patents relating to ethanol production processes. The ensuing litigation culminated in the Court finding that the patents were invalid and not infringed by any defendant. Those findings were further bolstered at a trial in which the Court then found the patents unenforceable due to inequitable conduct by the attorneys. In consideration of the Court’s previous holdings, Judge Miller reasoned that the defendants had shown that this case was exceptional and appropriate for fees.
