John C. McNett

Senior Counsel

John joined the firm in 1970 and has over the years tended to concentrate in litigation of intellectual property issues, while also handling patent licensing and prosecution matters. Prior to working with the firm, he had worked in his hometown of Fort Wayne, Indiana, as a television engineer, as a microbiologist, and as a construction worker. He has served as an adjunct professor teaching intellectual property at Purdue University. He has served as a mediator and as an arbitrator in intellectual property disputes.

John tends to focus his practice on issues that are difficult or complex either technically, legally, or diplomatically. He is comfortable working in all areas of technology. John has been selected for inclusion in Super Lawyer listings in Indiana each year from 2004 to 2009.

Representative Experience

  • Counsel of record for the prevailing Charlie Christianson and lead on the briefing in the U.S. Supreme Court (orally argued there by Stuart Lefstein) in a case involving patents and trade secrets in the M-16 assault rifle. This case is among the 10 most frequently cited cases in patent law, according to PatentlyO.com. Christianson v. Colt Industries Operating Corp. 1988
  • Lead counsel in patent case suspended during reexamination in which all asserted claims of adversary’s patent were found invalid. See BASF v. Reilly Industries 2007.
  • Lead trial counsel at trial and appeal in a patent infringement suit involving a steering wheel for computer games, finding infringement of client’s patent by defendant's product. See JVW Enterprises v. Interact Accessories, 2005.
  • Lead counsel in patent infringement suit, affirmed on appeal, involving 3 patents on digital television translators in which all of adversary's asserted claims were found invalid. See K-Tech Telecommunications v. Blonder Tongue Laboratories, Inc. 2014
